5. HOW CONTRACTS ARE FORMED
To conclude a purchase agreement through our Website, follow this procedure:
Select the desired product and add it to the cart;
Proceed to the checkout section, provide the necessary information, and confirm the purchase terms;
Choose a payment method and complete the transaction;
Upon completing the order, you will receive an email confirming receipt of the order.
Please note that this email does not constitute final confirmation of the contract. The contract is considered concluded only after we send you a written confirmation, including shipping details or an invoice.
6. PRODUCT AVAILABILITY

If the product you ordered is unavailable, we will promptly notify you and offer possible alternatives or a refund of the paid amount.
7. ORDER CANCELLATION
You have the right to cancel an order before it is shipped. If the cancellation occurs after the order has been processed or shipped, our Return Policy applies. FINE CORK PORTUGAL reserves the right to refuse order fulfillment for objective reasons (e.g., website errors, suspected fraud, product unavailability, etc.).
8. DELIVERY
We deliver within Portugal, as well as to other European Union countries and beyond, depending on delivery conditions. Delivery costs and times are calculated automatically during order placement and depend on weight, volume, and delivery address.
Delivery times are indicative and may vary depending on logistical conditions, holidays, and other factors. We commit to informing you about the delivery status via email.
9. UNDELIVERABLE ITEMS
If delivery is impossible due to the absence of the recipient, incorrect address, or other factors beyond our control, the courier service will leave a notice and/or attempt redelivery. If delivery still cannot be completed, the product will be returned to us, and we will contact you to agree on further actions. Additional charges for redelivery may apply.
10. RISK AND OWNERSHIP
The risk of accidental loss or damage to the product passes to the buyer upon delivery to the address specified in the order. Ownership of the product transfers to the buyer only after full payment.
11. PRICE AND PAYMENT
All prices listed on the site are in euros (EUR) and include the applicable Value Added Tax (VAT), unless otherwise stated. During the order process, delivery costs and/or other applicable fees may be added to the price, which will be indicated separately before completing the purchase.
Payment can be made using the following methods:

Payment is considered made after the transaction is confirmed by the payment system. In case of payment refusal, the order will be canceled.
12. VALUE ADDED TAX
All prices on the Website are stated in euros (EUR) and include Value Added Tax (VAT), where applicable, in accordance with the tax laws of the Portuguese Republic.
We comply with Portuguese tax legislation and collect VAT on sales as required by law.
13. RETURN POLICY
Right of Withdrawal
You have the right to withdraw from the concluded contract without stating reasons within 14 calendar days from the date you or a third party specified by you receives the product.
To exercise the right of withdrawal, you must send a clear written notice to help@finecorkportugal.com. We will send you confirmation of receipt of your request.
After receiving the return notice, you must return the product no later than 14 days from the notification date. Returns are possible if the product:
Has not been used;
Is in its original packaging;
Is undamaged and in a saleable condition.
Return shipping costs are borne by the buyer.
Return of Defective Products
If you receive a damaged or defective product, you must notify us within 48 hours of receipt. We will arrange a free return or replacement of the product as soon as possible. If replacement is not possible, a full refund will be issued.
14. LIABILITY AND LIMITATIONS
FineCork Portugal is not liable for any losses or damages arising from the use or inability to use this Website, including but not limited to: direct or indirect losses, lost profits, data loss, business interruption, or other intangible losses, even if FineCork Portugal was advised of the possibility of such damages.
FineCork Portugal commits to taking all reasonable measures to ensure the accuracy of the information presented on the site but does not guarantee its absolute completeness, timeliness, or suitability for specific user purposes.
FineCork Portugal is not liable for non-fulfillment of its obligations if such non-fulfillment is caused by force majeure circumstances, including but not limited to: natural disasters, strikes, wars, terrorist acts, supply disruptions, technical failures, or legal restrictions.
15. INTELLECTUAL PROPERTY
All intellectual property rights, including copyrights, trademarks, logos, images, designs, software, texts, and other elements posted on this Website, belong to FineCork Portugal or are used legally with the appropriate licenses.
It is prohibited to use, reproduce, copy, distribute, transmit, publish, upload, modify, or create derivative works based on the site’s materials without prior written permission from FineCork Portugal.
Any unauthorized use may result in civil and/or criminal liability in accordance with the current legislation of the Portuguese Republic and international agreements.
16. VIRUSES, HACKING, AND OTHER CYBERCRIMES

19. NOTICES

A notice is considered received and properly delivered: immediately after posting on our Website; 24 hours after sending an email; or three days after the date of mailing a letter.

We may transfer, assign, encumber, subcontract, or otherwise dispose of the contract or any of our rights or obligations under it at any time during its term, provided that such actions do not affect your legal rights as a consumer.
21. EVENTS BEYOND OUR CONTROL
FineCork Portugal shall not be liable for any failure or delay in the performance of any of our obligations under a contract that is caused by events beyond our reasonable control (Force Majeure Event).
A Force Majeure Event includes, but is not limited to: strikes, lock-outs, or other industrial actions; civil unrest, terrorist attacks or threats thereof, war (declared or not), fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster; impossibility of using transport or telecommunications networks; acts, decrees, legislation, regulations, or restrictions of any government or public authority.
Our obligations under the contract shall be suspended for the duration of the Force Majeure Event, and we will be entitled to an extension of time to perform our obligations for the duration of that period.
22. WAIVER
If we fail to insist upon strict performance of any of your obligations under these Terms or any contract, or if we fail to exercise any of the rights or remedies to which we are entitled, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these Terms shall be effective unless it is expressly stated to be a waiver and communicated to you in writing.
23. SEVERABILITY
If any of these Terms or any provisions of a contract are held to be invalid, unlawful, or unenforceable by any competent authority, such term, condition, or provision shall be deemed severed from the remaining terms, conditions, and provisions, which shall continue to be valid to the fullest extent permitted by law.
24. ENTIRE AGREEMENT
These Terms and any document expressly referred to in them constitute the entire agreement between you and FineCork Portugal with respect to the subject matter of any contract and supersede any prior understanding, arrangement, or agreement, whether oral or written.
Both parties acknowledge that, in entering into a contract, neither party relies on any statement, representation, assurance, or warranty that is not set out in these Terms or those documents.
25. OUR RIGHT TO MODIFY THESE TERMS
We reserve the right to revise and amend these Terms at any time. You will be subject to the policies and Terms in force at the time you use this Website or place an order, unless any change to these Terms is required by law or governmental authority, in which case it will apply to previously placed orders as well.
If we make substantial changes to these Terms, we will notify users on the Website or via email where possible.
26. APPLICABLE LAW AND JURISDICTION
These Terms, as well as any agreement for the purchase of products through this Website, shall be governed by and construed in accordance with the laws of the Portuguese Republic.
Any dispute arising out of or in connection with the use of this Website or such contracts shall be subject to the exclusive jurisdiction of the Portuguese courts. However, this provision does not affect your statutory rights as a consumer under the laws of your place of residence.
